What is US Law section 230?
Data service providers who remove or restrict content from their services that they consider "obscene, lewd, lascivious, filthy, excessively violent, harassing, or otherwise objectionable, irrespective of whether such material is legally protected" are immune from civil liability under Section 230(c)(2).
As the government are not able to regulate all forms of media content, the moderation of published content have fallen into the hands of these social media platforms to self regulate which is how US Law section 230 come into place. However, increasing debate with the outdated law has imposed issues onto the internet as it had not been prepared to see the rise in social media platforms like Youtube which came out in 2005 and Tiktok coming out much later.
TikTok's ban on misogyny and misgendering attempts to clean up For You Pages/FYP
More details about what can and cannot be posted on videos have recently been added. In 2022, the TikTok creator and owner ByteDance amended its community guidelines with a list of new infractions that merit a ban. The modification targets both content that is intended to upset LGBTQ users in general and trans users in particular.
Content with anti-LGBTQ sentiment is now prohibited, including advocacy for conversion therapy, misgendering, and deadnaming (the practise of using a trans person's birth or former name). Posts that promote sexism, which is bias or hatred against women, are also prohibited. The modifications, according to a blog post by TikTok, "adding clarity on the types of hateful ideologies prohibited on our platform."
These posts and others won't appear on users' For You pages, which promote content based on prior views, according to TikTok. Any offensive posts should ideally be quickly deleted before spreading. Anti-LGBTQ speech, misogynistic messages, and other types of hatred were extensively disseminated on the network, according to a UK research from the previous year.
As TikTok producers have often stated, enforcing these new bans is where it truly counts. As a Chinese startup operating under a less-than-tolerant government, ByteDance has already drawn criticism.
The rise of political commentators on youtube
Over the years, along with the growing left the right wing individuals on these social media sites have also seen Internet personalities including Piers Morgan, Amala Ekpunobi, Brett Cooper, Jordan Peterson, Ben Shapiro, etc. These right wing commentators have become increasingly popular over the past few years in their decision to go against “woke” feminists. Among some of these popular personalities come Andrew tate and Pearl Davis otherwise known as JustPearlyThings which have been banned on platforms like TikTok.
Andrew Tate
Andrew Tate, frequently referred to as 'Top G' by his fanbase has been banned on social media platforms like Facebook, Instagram, and TikTok for his alleged misogynist and sexist remarks after receiving backlash from women's rights advocacy groups who was banned from YouTube, Instagram, Facebook and TikTok over 'toxic' comments against women, has been branded the 'emperor of cringe' after responding in video smoking a cigar and boasting about its emissions. Former kickboxer and influential person Andrew. His official profiles were deleted on Friday when Meta, the company that owns Facebook and Instagram, claimed they were against its regulations.
He has also criticised persons who seek mental health therapy and said that raped women are largely to blame for the attacks. He has also explained in detail how he may attack women. Mr. Tate addressed the social media prohibitions and said that parts of his words had been misinterpreted in a YouTube video that was published earlier this year.
YouTube removed a number of Tate-related channels "for multiple violations of our Community Guidelines and Terms of Service, including our hate speech policy," according to a representative for the business named Ivy Choi. The official Andrew Tate account was permanently barred from Twitter, according to a spokesman, however they did not say when this happened.
The freedom of speech argument with Andrew Tate does not apply in his seemingly “personal opinions” however, with th degree of his comments it has come to effect many of his young demographic, young men alike.
